Welcome to Touch of Class Interiors Black Country. These Terms of Service (“Terms”) govern the provision of painting, decorating, and related interior services by us. By engaging our services, requesting a quotation, or allowing us to commence work, you agree to be bound by these Terms.Please read them carefully. If you do not agree, you should not proceed with our services.

1. About Us

Touch of Class Interiors Black Country is a trading name of a  sole trader.

2. Definitions

  • “We”, “Us”, “Our” or “the Contractor”: Touch of Class Interiors Black Country.
  • “You”, “Your” or “the Customer”: The person, company, or entity engaging our services.
  • “Services”: Painting, decorating, surface preparation, wallpapering, and any related interior works as described in our SERVICES menu.
  • “Quotation”: Our written estimate of the work and price, which forms the basis of the contract once accepted i.

3. Quotations and Contract Formation

  • All quotations are valid for 30 days unless stated otherwise.
  • Our quotation is based on a site survey (where applicable) and the information you provide. It outlines the scope of work, materials, and price.
  • The contract is formed when you accept our quotation in writing (email or signed document) or when we commence work with your agreement.
  • Any variations, additional work, or changes to the scope must be agreed in writing and may incur extra costs.
  • We reserve the right to refuse or amend a quotation if site conditions differ significantly from our assessment.

4. Customer ObligationsTo enable us to provide the Services efficiently:

  • Provide clear access to the work area and ensure it is safe and free from hazards.
  • Remove or adequately protect all furniture, personal items, floor coverings, and valuables. We are not responsible for damage to items not properly protected by you.
  • Ensure the premises are vacant or that occupants can tolerate dust, noise, and temporary disruption during works.
  • Supply electricity, water, and toilet facilities where required.
  • Inform us of any known issues with surfaces, previous coatings, damp, or structural problems before work begins.
  • Make the site available on agreed dates and times.

Failure to meet these obligations may result in delays or additional charges.

5. Our Obligations and Standards of Work

  • We will perform the Services with reasonable care and skill, in accordance with industry standards and the Consumer Rights Act 2015.
  • We use quality materials suitable for the project. Natural variations in paint, wallpaper, or wood grain are not considered defects.
  • We will take reasonable care to minimise mess and clean the work area at the end of each day where practical. A final clean will be carried out upon completion.
  • We aim to complete the work within the agreed timeframe, but time is not of the essence unless explicitly agreed in writing.
  • Any defects or snagging items must be notified to us in writing within 7 days of completion. We will remedy genuine defects at no extra cost, subject to fair wear and tear.

6. Materials and Products

  • All materials supplied by us remain our property until full payment is received.
  • We are not responsible for variations in colour, batch, or finish due to manufacturer changes or lighting conditions.
  • You are responsible for any specific materials or colours you select or supply.

7. Pricing and Payment

  • The price quoted is inclusive of VAT unless stated otherwise. VAT will be added at the prevailing rate.
  • A deposit of [e.g., 30-50%] may be required before work commences, with the balance due upon completion or as per the agreed payment schedule.
  • For larger projects, staged payments may apply.
  • Payment is accepted by bank transfer, cash, or other methods agreed in advance.
  • Invoices are due within 7 days of issuance (or immediately on completion for smaller jobs). Late payments may incur interest at 8% above the Bank of England base rate and recovery costs.
  • We reserve the right to suspend or withhold completion of works if payments are overdue.

8. Cancellations and Changes

  • If you cancel after the contract is formed but before work starts, you may forfeit any deposit paid to cover our preparation costs.
  • Cancellations within 48 hours of a scheduled start date may incur a cancellation fee.
  • We may cancel or postpone if we encounter unforeseen issues (e.g., unsafe conditions) or due to events beyond our control (see Force Majeure).
  • Any changes to the agreed work must be confirmed in writing.

9. Liability and Insurance

  • We carry public liability insurance. We are not liable for pre-existing defects in the property or damage caused by your failure to meet your obligations.
  • Our liability is limited to the value of the contract price for any direct loss caused by our negligence.
  • We are not responsible for consequential losses (e.g., loss of profit, business interruption) or damage to items not properly protected by you.
  • Nothing in these Terms excludes or limits our liability for death, personal injury caused by negligence, or any liability that cannot be excluded by law.

10. Force MajeureWe are not liable for delays or failure to perform due to circumstances beyond our reasonable control, including (but not limited to) adverse weather, strikes, supply chain issues, pandemics, or government restrictions.11. ComplaintsAny complaints should be raised with us in writing as soon as possible. We aim to resolve issues fairly and promptly. If unresolved, you may refer the matter to relevant dispute resolution services or trading standards.12. Data Protection and PrivacyWe process your personal data in accordance with the UK GDPR and our Privacy Policy (available on touchofclassservice.co.uk). We will only use your information to provide the Services, communicate with you, and comply with legal obligations. We do not sell your data to third parties.13. General

  • These Terms, together with our quotation and any written variations, constitute the entire agreement between us.
  • If any provision is found invalid, the remaining provisions remain in effect.
  • We may update these Terms from time to time. Continued engagement with our services after changes constitutes acceptance of the updated Terms.
  • These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the English courts.
